ถ้าคู่สมรสฝ่ายใดฝ่ายหนึ่งต้องรับผิดเป็นส่วนตัวเพื่อชำระหนี้ที่ก่อไว้ก่อนหรือระหว่างสมรส ให้ชำระหนี้นั้นด้วยสินส่วนตัวของฝ่ายนั้นก่อน เมื่อไม่พอจึงให้ชำระด้วยสินสมรสที่เป็นส่วนของฝ่ายนั้น

English translation
If one spouse is personally liable for a debt incurred before or during the marriage, that debt shall be paid first out of that spouse's personal property, and, when that is insufficient, out of that spouse's share of the marital property.
