การฟ้องคดีไม่รับเด็กเป็นบุตร ชายผู้เป็นหรือเคยเป็นคู่สมรสต้องฟ้องภายในหนึ่งปีนับแต่วันเด็กเกิด แต่ห้ามมิให้ฟ้องเมื่อพ้นสิบปีนับแต่วันเกิดของเด็ก

ในกรณีที่มีคำพิพากษาของศาลแสดงว่า เด็กมิใช่เป็นบุตรชอบด้วยกฎหมายของชายผู้เป็นคู่สมรสคนใหม่ตามมาตรา ๑๕๓๗ หรือชายผู้เป็นคู่สมรสในการสมรสครั้งหลังตามมาตรา ๑๕๓๘ ถ้าชายผู้เป็นหรือเคยเป็นคู่สมรสซึ่งต้องด้วยบทสันนิษฐานว่าเด็กเป็นบุตรชอบด้วยกฎหมายของตนตามมาตรา ๑๕๓๖ ประสงค์จะฟ้องคดีไม่รับเด็กเป็นบุตร ให้ฟ้องคดีภายในหนึ่งปีนับแต่วันที่รู้ว่ามีคำพิพากษาถึงที่สุด

English translation

An action to repudiate a child must be brought by the man who is or was a spouse within one year from the day of the child's birth, and no such action may be brought after ten years from the day of the child's birth.

Where there is a judgment of the court showing that the child is not the legitimate child of the man who is the new spouse under Section 1537, or of the man who is the spouse in the later marriage under Section 1538, and the man who is or was a spouse, to whom the presumption under Section 1536 applies, wishes to bring an action to repudiate the child, he must bring it within one year from the day he learns that the judgment has become final.
