การแสดงเจตนาโดยสำคัญผิดในคุณสมบัติของบุคคลหรือทรัพย์สินเป็นโมฆียะความสำคัญผิดตามวรรคหนึ่ง ต้องเป็นความสำคัญผิดในคุณสมบัติซึ่งตามปกติถือว่าเป็นสาระสำคัญ ซึ่งหากมิได้มีความสำคัญผิดดังกล่าวการอันเป็นโมฆียะนั้นคงจะมิได้กระทำขึ้น

English translation
A declaration of intention is voidable if made under a mistake as to a quality of the person. Mistake under paragraph one must be a mistake as to the quality of the person which is considered as essential in the ordinary dealings, and without which such juristic act would have not been made.
