การแสดงเจตนาโดยสำคัญผิดในคุณสมบัติของบุคคลหรือทรัพย์สินเป็นโมฆียะความสำคัญผิดตามวรรคหนึ่ง ต้องเป็นความสำคัญผิดในคุณสมบัติซึ่งตามปกติถือว่าเป็นสาระสำคัญ ซึ่งหากมิได้มีความสำคัญผิดดังกล่าวการอันเป็นโมฆียะนั้นคงจะมิได้กระทำขึ้น

English translation
A declaration of intention is voidable if made under a mistake as to a quality of the person or of the property. Mistake under paragraph one must be a mistake as to the quality of the person or of the property which is considered as essential in the ordinary dealings, and without which such juristic act would have not been made.
