ความสำคัญผิดตามมาตรา ๑๕๖ หรือมาตรา ๑๕๗ ซึ่งเกิดขึ้นโดยความประมาทเลินเล่ออย่างร้ายแรงของบุคคลผู้แสดงเจตนา บุคคลนั้นจะถือเอาความสำคัญผิดนั้นมาใช้เป็นประโยชน์แก่ตนไม่ได้
