Une déclaration d'intention obtenue par fraude est annulable. Un acte visé au premier paragraphe n'est annulable pour cause de fraude que s'il est de nature à être inopposable à un tiers. Lorsqu'une partie a fait une déclaration d'intention à la suite d'une fraude commise par un tiers, cet acte n'est annulable que si l'autre partie avait connaissance, ou aurait dû avoir connaissance, de la fraude.
