ในกรณีที่ผู้เยาว์มิได้ถูกทอดทิ้ง แต่อยู่ในความอุปการะเลี้ยงดูของสถานสงเคราะห์เด็กตามกฎหมายว่าด้วยการสงเคราะห์และคุ้มครองเด็ก บิดาและมารดา หรือบิดาหรือมารดาในกรณีที่มารดาหรือบิดาคนใดคนหนึ่งตายหรือถูกถอนอำนาจปกครอง จะทำหนังสือมอบอำนาจให้สถานสงเคราะห์เด็กดังกล่าวเป็นผู้มีอำนาจให้ความยินยอมในการรับผู้เยาว์เป็นบุตรบุญธรรมแทนตนก็ได้ ในกรณีเช่นนั้นให้นำความในมาตรา ๑๕๙๘/๒๒ มาใช้บังคับโดยอนุโลม หนังสือมอบอำนาจตามวรรคหนึ่งจะถอนเสียมิได้ตราบเท่าที่ผู้เยาว์ยังอยู่ในความอุปการะเลี้ยงดูของสถานสงเคราะห์เด็กนั้น

English translation
In case the minor to be adopted has not been deserted but has been under supervision of an institution for child welfare under the law on child welfare and protection, the parents or one of the parents, in case the other died or whose parental power has been deprived, may make a letter of power entrusting the said institution to give consent to the adoption, and the provisions of Section 1598/22 shall apply, mutatis mutandis. The letter of power under paragraph one cannot be revoked as long as the minor is supported and maintained by that institution.
