ในกรณีที่ผู้เยาว์มิได้ถูกทอดทิ้ง แต่อยู่ในความอุปการะเลี้ยงดูของสถานสงเคราะห์เด็กตามกฎหมายว่าด้วยการสงเคราะห์และคุ้มครองเด็ก บิดาและมารดา หรือบิดาหรือมารดาในกรณีที่มารดาหรือบิดาคนใดคนหนึ่งตายหรือถูกถอนอำนาจปกครอง จะทำหนังสือมอบอำนาจให้สถานสงเคราะห์เด็กดังกล่าวเป็นผู้มีอำนาจให้ความยินยอมในการรับผู้เยาว์เป็นบุตรบุญธรรมแทนตนก็ได้ ในกรณีเช่นนั้นให้นำความในมาตรา ๑๕๙๘/๒๒ มาใช้บังคับโดยอนุโลม หนังสือมอบอำนาจตามวรรคหนึ่งจะถอนเสียมิได้ตราบเท่าที่ผู้เยาว์ยังอยู่ในความอุปการะเลี้ยงดูของสถานสงเคราะห์เด็กนั้น

Si le mineur à adopter n'a pas été abandonné mais est placé sous la tutelle d'un établissement de protection de l'enfance conformément à la loi relative à la protection de l'enfance, les parents, ou l'un d'eux en cas de décès ou de déchéance de l'autorité parentale de l'autre, peuvent établir une procuration autorisant ledit établissement à consentir à l'adoption. Les dispositions de l'article 1598/22 s'appliquent alors, mutatis mutandis. Cette procuration est irrévocable tant que le mineur est pris en charge par cet établissement.
