เมื่อมีพินัยกรรมก่อตั้งมูลนิธิขึ้นตามมาตราก่อน ให้เป็นหน้าที่ของทายาทหรือผู้จัดการมรดก แล้วแต่กรณี ที่จะต้องร้องขอให้รัฐบาลให้อำนาจจัดตั้งขึ้นเป็นนิติบุคคลตามมาตรา ๑๑๔ แห่งประมวลกฎหมายนี้ เว้นแต่จะได้มีข้อกำหนดไว้ในพินัยกรรมเป็นอย่างอื่น ถ้าบุคคลดังกล่าวแล้วมิได้ร้องขอให้รัฐบาลให้อำนาจ บุคคลผู้มีส่วนได้เสียคนหนึ่งคนใดหรือพนักงานอัยการจะเป็นผู้ร้องขอก็ได้ หมายเหตุ: [เลขมาตรา ๑๑๔ แก้ไขเพิ่มเติมโดยมาตรา ๑๕ แห่งพระราชบัญญัติให้ใช้บทบัญญัติบรรพ ๑ แห่งประมวลกฎหมายแพ่งและพาณิชย์ที่ได้ตรวจชำระใหม่ พ.ศ. ๒๕๓๕]

English translation
Where a will establishing a foundation has been made under the preceding Section, it is the duty of the heirs or of the administrator of the estate, as the case may be, to apply for government authorisation to establish it as a juristic person under Section 114 of this Code, unless the will provides otherwise.
If those persons do not apply for authorisation, any interested person or the public prosecutor may do so.
