ในระหว่างที่เงื่อนไขยังไม่สำเร็จ คู่กรณีฝ่ายหนึ่งฝ่ายใดแห่งนิติกรรมอันอยู่ในบังคับเงื่อนไขจะต้องงดเว้นไม่กระทำการอย่างหนึ่งอย่างใดให้เป็นที่เสื่อมเสียประโยชน์แก่คู่กรณีอีกฝ่ายหนึ่ง ซึ่งจะพึงได้จากความสำเร็จแห่งเงื่อนไขนั้น
