ถ้าผู้จัดการเป็นผู้ไร้ความสามารถ ท่านว่าจะต้องรับผิดชอบแต่เพียงตามบทบัญญัติว่าด้วยค่าสินไหมทดแทนเพื่อละเมิด และว่าด้วยการคืนลาภมิควรได้เท่านั้น
