ถ้าเมื่อบังคับตามสัญญาค้ำประกันนั้น ผู้ค้ำประกันไม่ชำระหนี้ทั้งหมดของลูกหนี้ รวมทั้งดอกเบี้ย ค่าสินไหมทดแทน และอุปกรณ์ด้วยไซร้ หนี้ยังเหลืออยู่เท่าใด ท่านว่าลูกหนี้ยังคงรับผิดต่อเจ้าหนี้ในส่วนที่เหลือนั้น มาตรา ๖๘๕/๑[24] บรรดาข้อตกลงเกี่ยวกับการค้ำประกันที่แตกต่างไปจาก
