Section 13 — How and when to challenge a judge

ถ้ามีเหตุที่จะคัดค้านได้อย่างใดอย่างหนึ่งดังที่กล่าวไว้ในสองมาตราก่อนเกิดขึ้นแก่ผู้พิพากษาคนใดที่นั่งในศาล
(๑) ผู้พิพากษานั้นเองจะยื่นคำบอกกล่าวต่อศาลแสดงเหตุที่ตนอาจถูกคัดค้าน แล้วขอถอนตัวออกจากการนั่งพิจารณาคดีนั้นก็ได้
(๒) คู่ความที่เกี่ยวข้องอาจยกข้อคัดค้านขึ้นอ้างโดยทำเป็นคำร้องยื่นต่อศาล แต่ถ้าตนได้ทราบเหตุที่พึงคัดค้านได้ก่อนวันสืบพยาน ก็ให้ยื่นคำร้องคัดค้านเสียก่อนวันสืบพยานนั้น หรือถ้าทราบเหตุที่พึงคัดค้านได้ในระหว่างพิจารณา ก็ให้ยื่นคำร้องคัดค้านไม่ช้ากว่าวันนัดสืบพยานครั้งต่อไป แต่ต้องก่อนเริ่มสืบพยานเช่นว่านั้นเมื่อได้ยื่นคำร้องดังกล่าวแล้ว ให้ศาลงดกระบวนพิจารณาทั้งปวงไว้ก่อนจนกว่าจะได้มีคำชี้ขาดในเรื่องที่คัดค้านนั้นแล้ว แต่ความข้อนี้มิให้ใช้แก่กระบวนพิจารณาซึ่งจะต้องดำเนินโดยมิชักช้า อนึ่ง กระบวนพิจารณาทั้งหลายที่ได้ดำเนินไปก่อนได้ยื่นคำร้องคัดค้านก็ดี และกระบวนพิจารณาทั้งหลายในคดีที่จะต้องดำเนินโดยมิชักช้า แม้ถึงว่าจะได้ดำเนินไปภายหลังที่ได้ยื่นคำร้องคัดค้านก็ดี เหล่านี้ย่อมสมบูรณ์ไม่เสียไป เพราะเหตุที่ศาลมีคำสั่งยอมฟังคำคัดค้าน เว้นแต่ศาลจะได้กำหนดไว้ในคำสั่งเป็นอย่างอื่นถ้าศาลใดมีผู้พิพากษาคนเดียว และผู้พิพากษาคนนั้นถูกคัดค้าน หรือถ้าศาลใดมีผู้พิพากษาหลายคน และผู้พิพากษาทั้งหมดถูกคัดค้าน ให้ศาลซึ่งมีอำนาจสูงกว่าศาลนั้นตามลำดับเป็นผู้ชี้ขาดคำคัดค้านถ้าศาลใดมีผู้พิพากษาหลายคน และผู้พิพากษาที่มิได้ถูกคัดค้านรวมทั้งข้าหลวงยุติธรรม ถ้าได้นั่งพิจารณาด้วยมีจำนวนครบที่จะเป็นองค์คณะและมีเสียงข้างมากตามที่กฎหมายต้องการ ให้ศาลเช่นว่านั้นเป็นผู้ชี้ขาดคำคัดค้าน แต่ในกรณีที่อยู่ในอำนาจของผู้พิพากษาคนเดียวจะชี้ขาดคำคัดค้าน ห้ามมิให้ผู้พิพากษาคนนั้นมีคำสั่งให้ยกคำคัดค้านโดยผู้พิพากษาอีกคนหนึ่งหรือข้าหลวงยุติธรรมมิได้เห็นพ้องด้วยถ้าศาลใดมีผู้พิพากษาหลายคน และผู้พิพากษาที่มิได้ถูกคัดค้าน แม้จะนับรวมข้าหลวงยุติธรรมเข้าด้วย ยังมีจำนวนไม่ครบที่จะเป็นองค์คณะและมีเสียงข้างมากตามที่กฎหมายต้องการ หรือถ้าผู้พิพากษาคนเดียวไม่สามารถมีคำสั่งให้ยกคำคัดค้านเสียด้วยความเห็นพ้องของผู้พิพากษาอีกคนหนึ่ง หรือข้าหลวงยุติธรรมตามที่บัญญัติไว้ในวรรคก่อน ให้ศาลซึ่งมีอำนาจสูงกว่าศาลนั้นตามลำดับเป็นผู้ชี้ขาดคำคัดค้าน

English translation

If any of the grounds of challenge mentioned in the two preceding sections arises with respect to any judge sitting in the court:
(1) that judge may himself submit a notice to the court stating the ground on which he may be challenged, and may then withdraw from sitting in the trial of that case; or
(2) the party concerned may raise the challenge by making a motion filed with the court; but if the party became aware of the ground of challenge before the date of taking evidence, the motion of challenge must be filed before that date of taking evidence; or if the party becomes aware of the ground of challenge during the trial, the motion of challenge must be filed not later than the next date appointed for taking evidence, but before the commencement of the taking of evidence on that occasion.
When such a motion has been filed, the court shall stay all proceedings until a ruling on the challenge has been made; but this shall not apply to proceedings that must be conducted without delay. Furthermore, all proceedings conducted before the motion of challenge was filed, and all proceedings in a case that must be conducted without delay even though conducted after the motion of challenge was filed, shall remain valid and shall not be vitiated by reason of the court's order upholding the challenge, unless the court has otherwise provided in its order.
If a court has only one judge and that judge is challenged, or if a court has several judges and all of them are challenged, the court next higher in authority to that court, in order of rank, shall rule on the challenge.
If a court has several judges, and the judges who are not challenged, together with the justice commissioner if he has sat in the trial, are of a number sufficient to constitute a quorum and to form the majority required by law, such court shall rule on the challenge; but in a case within the power of a single judge to rule on the challenge, that judge shall not make an order dismissing the challenge without the concurrence of another judge or of the justice commissioner.
If a court has several judges, and the judges who are not challenged, even counting in the justice commissioner, are still not of a number sufficient to constitute a quorum and to form the majority required by law, or if the single judge is unable to make an order dismissing the challenge with the concurrence of another judge or of the justice commissioner as provided in the preceding paragraph, the court next higher in authority to that court, in order of rank, shall rule on the challenge.

Section 13 is the procedural core of Chapter 2, giving effect to the grounds in Sections 11 and 12. It offers two routes: voluntary recusal by the judge under (1), or a formal motion by the party under (2), with strict timing tied to the evidence-taking stage. Filing a challenge stays the proceedings, except steps that must be taken without delay, and the section protects the validity of steps already taken, so that upholding a challenge does not automatically unravel prior proceedings unless the court so orders. The final paragraphs allocate the power to rule on the challenge, escalating to the next higher court where the challenged court cannot itself form a proper quorum. The actual hearing and final ruling on the challenge are governed by Section 14.

Why this matters in practice

Timing decides everything here: raise the challenge before the evidence stage, or as soon as the ground appears, or you risk losing the right. Filing it normally freezes the case, so it is a serious step, not a delaying tactic. Note that steps already validly taken usually survive even if the challenge succeeds. Because the deadlines and the choice of which court decides are easy to get wrong, work through the mechanics with a lawyer before filing.

Frequently asked questions

By when must I file a challenge against a judge?

If you know the ground before evidence is taken, you must file before that date. If the ground appears during the trial, you must file no later than the next evidence hearing and before that hearing begins.

Does filing a challenge stop the case?

Generally yes. Once the motion is filed the court stays all proceedings until the challenge is decided, except steps that must be taken without delay.

If the challenge succeeds, is everything done so far cancelled?

Not automatically. Steps validly taken before the motion, and urgent steps taken after it, remain valid unless the court specifically orders otherwise.
