Section 314: Seizure extends to fruits of property

การยึดสังหาริมทรัพย์มีรูปร่างของลูกหนี้ตามคำพิพากษานั้นให้มีผลเป็นการยึดครอบไปถึงดอกผลธรรมดาและดอกผลนิตินัยของทรัพย์นั้นด้วย
การยึดอสังหาริมทรัพย์ของลูกหนี้ตามคำพิพากษานั้นให้มีผลเป็นการยึดครอบไปถึง
(๑) เครื่องอุปกรณ์และดอกผลนิตินัยของทรัพย์นั้น
(๒) ดอกผลธรรมดาของทรัพย์นั้นที่ลูกหนี้ตามคำพิพากษามีสิทธิเก็บเกี่ยว เมื่อเจ้าพนักงานบังคับคดีได้แจ้งหรือปิดประกาศให้ลูกหนี้ตามคำพิพากษาและผู้ครอบครองหรือผู้ดูแลทรัพย์นั้นทราบในขณะทำการยึดว่าได้ยึดดอกผลด้วยแล้ว

English translation

The seizure of tangible movable property of the judgment debtor shall have the effect of extending to the natural fruits and the legal fruits of that property as well.
The seizure of immovable property of the judgment debtor shall have the effect of extending to:
(1) the equipment and accessories and the legal fruits of that property;
(2) the natural fruits of that property that the judgment debtor has a right to harvest, once the execution officer has, at the time of the seizure, notified or posted a notice informing the judgment debtor and the person in possession or the keeper of that property that the fruits have also been seized.

Section 314 sits in Part 3 on the seizure of property and fixes the scope of what a seizure reaches. Seizing movable property carries with it both natural fruits, such as crops or offspring, and legal fruits, such as rent or interest. Seizing immovable property carries the equipment and legal fruits automatically, but reaches the natural fruits only where the execution officer notifies or posts a notice at the time of the seizure. This provision belongs to the execution rules renumbered by the Civil Procedure Code Amendment Act (No. 30) B.E. 2560 (2017), and works together with the following sections on the effect of seizure and the custody of seized property.

Why this matters in practice

For creditors this means the value captured by a seizure can be larger than the asset alone: rent accruing on a seized building or interest on a seized instrument is caught too. If you want the crops or other natural fruits of seized land included, insist that the execution officer records the notice at the moment of seizure, because missing that step leaves the fruits outside the seizure. Frequently asked questions

Does seizing a rental property also seize the rent?

Yes. Under Section 314, seizure of immovable property extends to its legal fruits, which include rent, so rent that accrues after the seizure is captured too.

Are crops on seized land automatically seized?

Not automatically. Natural fruits such as crops are included only if the execution officer notified or posted a notice to the debtor and the possessor at the time of the seizure.
