Section 325 — Objection to an attachment order

เมื่อได้แจ้งคำสั่งอายัดสิทธิเรียกร้องให้บุคคลภายนอกตามมาตรา ๓๑๖ แล้ว บุคคลภายนอกนั้นอาจยื่นคำร้องคัดค้านคำสั่งอายัดต่อศาลได้ภายในสิบห้าวัน
บุคคลผู้จะต้องเสียหายเพราะคำสั่งอายัดอาจยื่นคำร้องคัดค้านคำสั่งดังกล่าวได้ภายในกำหนดเวลาดังต่อไปนี้ ทั้งนี้ ต้องไม่ช้ากว่าสิบห้าวันนับแต่วันทราบคำสั่งอายัด
(๑) ถ้าสิทธิเรียกร้องนั้นเป็นการให้ชำระเงิน ให้ยื่นคำร้องต่อศาลก่อนวันที่เจ้าพนักงานบังคับคดีจ่ายเงินดังกล่าวทั้งหมดหรือแต่บางส่วนแก่เจ้าหนี้ตามคำพิพากษา
(๒) ถ้าสิทธิเรียกร้องนั้นเป็นการให้ส่งมอบหรือโอนทรัพย์สิน ให้ยื่นคำร้องต่อศาลก่อนขายทอดตลาดหรือจำหน่ายโดยวิธีอื่นซึ่งทรัพย์สินนั้น
(๓) ถ้าสิทธิเรียกร้องนั้นเป็นการให้ชำระหนี้อย่างอื่นนอกจาก
(๑) และ
(๒) ให้ยื่นคำร้องต่อศาลก่อนที่บุคคลภายนอกจะปฏิบัติการชำระหนี้
เมื่อศาลสั่งรับคำร้องคัดค้านตามวรรคหนึ่งหรือวรรคสองแล้ว ให้ส่งสำเนาคำร้องแก่เจ้าหนี้ตามคำพิพากษา ลูกหนี้ตามคำพิพากษา และเจ้าพนักงานบังคับคดี และให้เจ้าพนักงานบังคับคดีงดการบังคับตามคำสั่งอายัดไว้ในระหว่างรอคำวินิจฉัยชี้ขาด เมื่อศาลทำการไต่สวนแล้ว ถ้าเป็นที่พอใจว่าสิทธิเรียกร้องของลูกหนี้ตามคำพิพากษานั้นมีอยู่จริงและอาจบังคับได้ ก็ให้ยกคำร้องนั้นเสียและมีคำสั่งให้บุคคลภายนอกปฏิบัติตามคำสั่งอายัด แต่ถ้าเป็นที่พอใจว่าคำร้องคัดค้านรับฟังได้ ให้ศาลมีคำสั่งถอนการอายัดสิทธิเรียกร้อง
ในระหว่างการพิจารณาคำร้องคัดค้านตามวรรคสาม เจ้าหนี้ตามคำพิพากษาอาจยื่นคำร้องว่าคำร้องคัดค้านนั้นไม่มีมูลและยื่นเข้ามาเพื่อประวิงการบังคับคดี เมื่อปรากฏพยานหลักฐานเบื้องต้นว่าคำร้องนั้นฟังได้ ศาลมีอำนาจสั่งให้ผู้ร้องคัดค้านวางเงินหรือหาประกันต่อศาลตามจำนวนและภายในระยะเวลาที่ศาลเห็นสมควร เพื่อเป็นประกันการชำระเงินค่าสินไหมทดแทนแก่เจ้าหนี้ตามคำพิพากษา สำหรับความเสียหายที่อาจได้รับจากการยื่นคำร้องคัดค้านนั้น ถ้าผู้ร้องคัดค้านไม่ปฏิบัติตามคำสั่งศาล ให้ศาลมีคำสั่งจำหน่ายคำร้องคัดค้าน ส่วนเงินหรือประกันที่วางไว้ต่อศาลดังกล่าว เมื่อศาลเห็นว่าไม่มีความจำเป็นต่อไป จะสั่งคืนหรือยกเลิกประกันนั้นก็ได้
ถ้าศาลได้มีคำสั่งให้บุคคลภายนอกปฏิบัติตามคำสั่งอายัด และบุคคลนั้นมิได้ปฏิบัติตามคำสั่งศาล เจ้าหนี้ตามคำพิพากษาอาจร้องขอให้ศาลบังคับคดีแก่บุคคลภายนอกเสมือนหนึ่งว่าบุคคลนั้นเป็นลูกหนี้ตามคำพิพากษา

English translation
When the attachment order in respect of a claim has been notified to the third party under Section 316, the third party may file an objection to the attachment order with the court within fifteen days.
A person who will be prejudiced by the attachment order may file an objection to that order within the following periods, provided that in no case shall it be later than fifteen days from the date of becoming aware of the attachment order:
(1) If the claim is for the payment of money, the objection shall be filed with the court before the execution officer pays that money, in whole or in part, to the judgment creditor.
(2) If the claim is for the delivery or transfer of property, the objection shall be filed with the court before the auction or other disposal of that property.
(3) If the claim is for the performance of an obligation other than those in (1) and (2), the objection shall be filed with the court before the third party performs the obligation.
When the court has ordered the objection under paragraph one or paragraph two to be accepted, a copy of the objection shall be served on the judgment creditor, the judgment debtor, and the execution officer, and the execution officer shall stay the enforcement of the attachment order pending the ruling. When the court has held an inquiry, if it is satisfied that the claim of the judgment debtor genuinely exists and is enforceable, it shall dismiss the objection and order the third party to comply with the attachment order; but if it is satisfied that the objection is well founded, the court shall order the attachment of the claim to be withdrawn.
During the consideration of the objection under paragraph three, the judgment creditor may file a motion that the objection has no merit and was filed to delay the execution. When there is prima facie evidence that the motion is well founded, the court has the power to order the objector to deposit money or provide security with the court in the amount and within the time the court thinks fit, as security for the payment of compensation to the judgment creditor for the damage that may be sustained from the filing of that objection. If the objector fails to comply with the order of the court, the court shall order the objection struck off. As for the money or security deposited with the court, the court may order its return or the cancellation of the security when it is of the opinion that it is no longer necessary.
If the court has ordered the third party to comply with the attachment order and that person does not comply with the order of the court, the judgment creditor may apply to the court to enforce against the third party as though that person were a judgment debtor.
In the case where the objection under paragraph one or paragraph two has no merit and was filed to delay the execution, the judgment creditor may file a motion with the court within thirty days from the date the court dismissed the objection, seeking an order that the objector pay compensation for the damage sustained. In such a case, the court has the power to order the matter to be tried as a separate case from the original case, and when the court has held an inquiry and is of the opinion that the motion is well founded, it shall order the objector to pay compensation in such amount as it thinks fit. If that person fails to comply with the order of the court, the judgment creditor may apply to the court to enforce against that person as though he were a judgment debtor.

Section 325 gives the third party and other prejudiced persons a way to challenge an attachment of claims within Part 6. The third party served under Section 316 may object within fifteen days, and any person who would be harmed by the order may object within the deadlines in (1) to (3), keyed to when the money is paid, the property disposed of, or the obligation performed, but never later than fifteen days from learning of the order. On acceptance the officer stays enforcement, and after an inquiry the court either dismisses the objection and orders compliance where the debtor's claim genuinely exists and is enforceable, mirroring the Section 321 standard, or withdraws the attachment where the objection is well founded. Later paragraphs guard against delay by allowing security, striking out, enforcement against a non-complying third party as if a judgment debtor, and a damages claim for a baseless objection. The provision was renumbered by the Civil Procedure Code Amendment Act (No. 30) B.E. 2560 (2017).
Why this matters in practice
If your bank account, wages, or receivable is caught by an attachment you think is wrong, this is how you fight it, but move fast: the fifteen-day window runs from when you learn of the order, and you must object before the money is paid out or the property sold. A weak objection filed just to stall is risky, because the court can order you to post security and later award damages to the creditor. Deciding whether an objection is worth filing, and framing it properly, is a good moment to consult a lawyer familiar with execution.
