English translation
If the income from immovable property, or from carrying on an industrial, commercial, agricultural or any other business of the judgment debtor, may be sufficient to pay the judgment debt together with the court fees and the fees of execution within a reasonable time, then, when the court sees fit or when the judgment debtor so requests, and there is no fact showing that it would be a delay of payment of the debt, the court may order the appointment of a manager of that immovable property or a manager of that business, delivering the whole or part of the income to the execution officer within the time and on the conditions the court sees fit to fix, in lieu of the sale or disposal of the property of the judgment debtor.

Firm annotation
Section 336 is the whole of Part 9 and offers an alternative to forced sale. Where the income stream from the debtor's immovable property or business could satisfy the judgment debt plus court and execution fees within a reasonable period, the court may appoint a manager to collect that income and remit it, in whole or part, to the execution officer on terms the court fixes. It may be ordered on the court's own initiative or on the debtor's application, but only if there is no indication it is being used to stall payment. This is referenced in Section 331, which makes the auction duty subject to Section 336, and it can preserve a going concern or valuable asset rather than liquidating it.
Why this matters in practice
If your income-producing property or business can pay the debt over time, this is a way to keep the asset instead of losing it at auction. To succeed, a debtor must show the court the income will realistically clear the debt and fees within a reasonable time and that the request is genuine, not a stalling move. Presenting credible figures is essential, so getting legal advice from a Thai lawyer before applying is worthwhile.
Frequently asked questions
Can I avoid having my property sold to pay a judgment debt?
Possibly. Under Section 336 the court may appoint a manager to run the property or business and pay its income toward the debt, if that income will clear the debt and fees within a reasonable time and the request is not a delaying tactic.
Who can ask for a manager to be appointed under Section 336?
The court may order it on its own view when it sees fit, or the judgment debtor may request it, provided there is no fact showing it is being used to delay payment.
