Section 352 — Handover and belongings left behind

ในกรณีตามมาตรา ๓๕๑
(๑) ให้เจ้าพนักงานบังคับคดีมีอำนาจส่งมอบทรัพย์นั้นทั้งหมดหรือบางส่วนให้เจ้าหนี้ตามคำพิพากษาเข้าครอบครองได้ทันที ถ้ามีสิ่งกีดขวางอันเป็นอุปสรรคต่อการส่งมอบ ให้เจ้าพนักงานบังคับคดีมีอำนาจทำลายสิ่งกีดขวางดังกล่าวได้ตามความจำเป็น
ถ้ายังมีสิ่งของของลูกหนี้ตามคำพิพากษาหรือของบุคคลใดอยู่ในทรัพย์นั้น ให้เจ้าพนักงานบังคับคดีทำบัญชีสิ่งของนั้นไว้ และมีอำนาจดำเนินการดังต่อไปนี้
(๑) ถ้าสิ่งของนั้นมีสภาพเป็นของสดของเสียได้ หรือมีสภาพอันจะก่อให้เกิดอันตรายได้ หรือถ้าหน่วงช้าไว้จะเป็นการเสี่ยงความเสียหายหรือค่าใช้จ่ายจะเกินส่วนแห่งค่าของสิ่งของนั้น ให้เจ้าพนักงานบังคับคดีมีอำนาจจำหน่ายสิ่งของนั้นได้ทันทีโดยวิธีขายทอดตลาดหรือวิธีอื่นที่เห็นสมควร และเก็บรักษาเงินสุทธิหลังจากหักค่าใช้จ่ายไว้แทนสิ่งของนั้น หรือทำลายสิ่งของนั้น หรือดำเนินการอื่นใดตามที่เห็นสมควรก็ได้ ทั้งนี้ ให้คำนึงถึงสภาพแห่งสิ่งของ ประโยชน์ของผู้มีส่วนได้เสีย และประโยชน์สาธารณะ
(๒) ถ้าสิ่งของนั้นมิใช่สิ่งของตามที่ระบุไว้ใน
(๑) ให้เจ้าพนักงานบังคับคดีมีอำนาจนำสิ่งของนั้นมาเก็บรักษาไว้ หรือมอบให้เจ้าหนี้ตามคำพิพากษาเป็นผู้รักษา หรือฝากไว้ ณ สถานที่ใด หรือแก่บุคคลใดตามที่เห็นสมควร แล้วแจ้งหรือประกาศให้ลูกหนี้ตามคำพิพากษาหรือเจ้าของสิ่งของมารับคืนไปภายในเวลาที่เจ้าพนักงานบังคับคดีกำหนด ถ้าลูกหนี้ตามคำพิพากษาหรือเจ้าของสิ่งของไม่มารับหรือไม่ยอมรับสิ่งของนั้นคืนไปภายในเวลาที่กำหนด ให้เจ้าพนักงานบังคับคดีดำเนินการตาม
(๑) โดยอนุโลม
เงินที่เจ้าพนักงานบังคับคดีได้มาจากการจำหน่ายสิ่งของตามวรรคสอง
(๑) หรือ
(๒) ถ้าลูกหนี้ตามคำพิพากษาหรือเจ้าของสิ่งของไม่มาขอรับคืนภายในกำหนดห้าปีนับแต่ได้รับแจ้งจากเจ้าพนักงานบังคับคดี ให้ตกเป็นของแผ่นดิน
ในกรณีที่สิ่งของตามวรรคสองถูกยึด อายัด หรือห้ามโอน ยักย้าย หรือจำหน่ายตามวิธีการชั่วคราวก่อนพิพากษาหรือเพื่อการบังคับคดีในคดีอื่น ให้เจ้าพนักงานบังคับคดีมีอำนาจย้ายสิ่งของดังกล่าวไปเก็บไว้ ณ สถานที่อื่นได้ตามที่เห็นสมควร ทั้งนี้ ให้เจ้าพนักงานบังคับคดีแจ้งศาลหรือเจ้าพนักงานบังคับคดีในคดีอื่นทราบด้วย
ให้ลูกหนี้ตามคำพิพากษาเป็นผู้เสียค่าใช้จ่ายที่เกิดจากการดำเนินการตามมาตรานี้ และให้ถือว่าเป็นหนี้ตามคำพิพากษาที่จะบังคับคดีกันต่อไป

English translation

In the case under Section 351:
(1) the executing officer shall have power to put the judgment creditor into immediate possession of all or part of the property. If there is an obstruction impeding the handover, the executing officer shall have power to remove such obstruction as necessary.
If there are still belongings of the judgment debtor or of any person in the property, the executing officer shall make an inventory of them and shall have power to proceed as follows:
(1) if the belongings are perishable, or of a nature that may cause danger, or if delay would risk loss or expense exceeding the value of the belongings, the executing officer shall have power to dispose of them immediately by auction or another appropriate method, and to keep the net proceeds after deducting expenses in place of the belongings, or to destroy them, or to take any other action as deemed appropriate, having regard to the nature of the belongings, the interests of the interested persons, and the public interest;
(2) if the belongings are not those specified in (1), the executing officer shall have power to store them, or entrust them to the judgment creditor for safekeeping, or deposit them at any place or with any person as deemed appropriate, and then notify or announce to the judgment debtor or owner of the belongings to collect them within the time set by the executing officer. If the judgment debtor or owner does not collect or refuses to take back the belongings within the time set, the executing officer shall proceed under (1) mutatis mutandis.
Money the executing officer obtains from disposing of belongings under paragraph two (1) or (2), if the judgment debtor or owner does not apply to collect it within five years from being notified by the executing officer, shall become the property of the State.
Where the belongings under paragraph two are seized, attached, or prohibited from transfer, removal or disposal under a provisional measure before judgment or for execution in another case, the executing officer shall have power to move them to another place as deemed appropriate, and shall notify the court or the executing officer in the other case.
The judgment debtor shall bear the expenses arising from action under this Section, which shall be deemed a judgment debt to be further enforced.

This is the operative handover section when an eviction property is vacant, giving the executing officer power to put the creditor in possession and to remove physical obstructions. It then sets a careful regime for third-party and debtor belongings found on site: an inventory, immediate disposal of perishable or hazardous items, and safe storage of the rest pending collection. Unclaimed proceeds escheat after five years, echoing Section 345, and the closing paragraph makes the officer's costs a judgment debt enforceable against the debtor. Paragraph two is also imported by Section 355 for demolition and removal cases.

Why this matters in practice

As the winning creditor you can be put into possession of empty property quickly, but you may be asked to store the loser's belongings, so plan for that role. Do not throw items out yourself: only the officer may dispose of, store or destroy them under the inventory rules, and doing it wrongly can expose you to claims. The debtor owes the removal and storage costs as a judgment debt, so keep records to recover them.   1. Supreme Court Judgment No. 3459/2564 (2021)

    Expenses a judgment creditor must advance to carry out an execution step are, under Section 352 paragraph five (read with Sections 358 paragraph two and 359 paragraph four), deemed a judgment debt to be enforced further; until the creditor has actually paid such expenses, there is no ground to issue a writ to seize the debtor's property to recover them.

    The plaintiffs sought to seize the defendant's property to recover the cost of registering the cancellation of a transfer. The court held that such costs become a judgment debt the creditor may enforce only after the creditor has actually paid them; since the plaintiffs had not yet paid the registration costs, there was no ground to issue a writ of execution against the defendant.

What happens to belongings left in a property after eviction?

Under Section 352, the executing officer inventories them. Perishable or hazardous items may be sold or destroyed at once; other belongings are stored and the owner given time to collect them.

Who pays for removing and storing the debtor's belongings?

The judgment debtor. Section 352 paragraph five deems those expenses a judgment debt that the creditor can enforce in further execution.

What if no one collects the stored belongings?
