A Thai non-compete is neither automatically void nor automatically binding. Under section 5 of the Unfair Contract Terms Act B.E. 2540, a term restricting someone’s freedom to work is enforceable only so far as it is not an unreasonable restriction, judged on the activity, the area and the duration.
