Section 259: Where the ticket is a public admission ticket

Section 259 sets no elements of its own. It takes the three acts described in Section 258, namely forging a ticket, altering a genuine one so that it differs from the original in order to make another person believe it has a higher value than it really has, and erasing or otherwise dealing with a mark showing that the ticket can no longer be used so that it may be used again, and applies them where the ticket is one sold to the public for admission to any place. Cinema, concert, exhibition and sporting-event tickets fall here, while the passenger ticket used in public transport stays under Section 258. The distinction is worth a lighter penalty: up to one year, or a fine of up to 20,000 baht, or both, against up to two years, or a fine of up to 40,000 baht, or both, under Section 258. Using, selling or exchanging a ticket produced under either section is Section 260, which fixes one penalty for both. Making or possessing the tools is Section 261, and Section 263 punishes the maker who also circulates the ticket once only. The current rates were set by Section 4 of the Penal Code Amendment Act (No. 26) B.E. 2560.
