A legal basis recognised by Section 1516 of the Thai Civil and Commercial Code entitling a spouse to petition for divorce. The twelve statutory grounds include adultery, misconduct causing serious harm, desertion for more than one year, imprisonment for more than one year, separation for more than three years, insanity, breach of bond of good behaviour, incurable communicable disease, and physical incapacity precluding cohabitation.
The ground must be pleaded and proved in the Juvenile and Family Court. Only a spouse who is not at fault may rely on it, and the action must be filed within one year of discovering the cause, except where the misconduct is ongoing.
