A ground for divorce (เหตุฟ้องหย่า, het fong ya, également appelé Motifs de divorce ou causes of divorce) is a fact that Section 1516 of the Thai Code civil et commercial recognises as entitling one spouse to a divorce by court judgment. Thailand has no court divorce on demand: if the other spouse will not sign at the amphur, the petitioner must plead and prove one of the twelve statutory grounds before the Juvenile and Tribunal de la famille. The list is closed, and the choice of ground shapes the case.

The grounds fall into two families. Fault grounds, such as adultère, cruelty and désertion, require proof of the other spouse’s conduct. Status grounds, such as three years of separation, imprisonment, disappearance or incurable illness, need only proof of the situation. Since 23 January 2025 the section is worded for spouses of any gender.

The petition is filed at the Juvenile and Family Court in Thai, with certified translations of foreign evidence. The frais de justice for a divorce claim without property is 200 baht; a property claim adds 2% of the amount claimed, capped at 200,000 baht. Mediation is offered before trial, and most first-instance cases are decided within six to twelve months. A marriage registered abroad is proved with a translated and legalised certificate.
The common mistake is pleading the ground that sounds strongest rather than the one that can be proved. Three years of living apart under Section 1516(4/2) is often easier to establish than adultery, and carries no fault finding. Another is waiting: under Section 1529 a claim based on grounds (1), (2), (3) or (6) is extinguished one year after the petitioner learned of the facts, although continuing conduct restarts the period. Grounds based on a state of affairs, such as separation, are not subject to that limit while the state continues.

A ground can be lost. Section 1517 bars a divorce for adultery or misconduct that the petitioner consented to or connived at, and Section 1518 provides that forgiveness extinguishes the right to rely on the conduct. A spouse who resumes cohabitation after discovering an affair will struggle to plead it.
The ground proved affects the consequences. A fault finding supports compensation under Section 1523 and a living allowance under Section 1526, whereas a status ground carries neither. Property division under Section 1533 and garde à vue are decided on their own rules whichever ground succeeds. Where the couple can reach terms, grounds become irrelevant: a divorce by mutual consent at the amphur under Section 1514 needs none, as explained in the guide to divorce en Thaïlande.

La séparation est souvent la plus facile à prouver car elle ne nécessite aucune preuve de faute, seulement la preuve que les époux vivent séparément.
