A bank’s export credit went bad, the borrower company went through bankruptcy, and the Central Bankruptcy Court later cancelled the bankruptcy under Bankruptcy Act s.135(3). The four guarantors argued that freed them too. The Supreme Court said no: under CCC s.698 a guarantor is released only when the underlying debt itself dies — bankruptcy relief is personal to the debtor.
