ข้อจำกัดสิทธิแห่งเจ้าของอสังหาริมทรัพย์ซึ่งกฎหมายกำหนดไว้นั้น ท่านว่าไม่จำต้องจดทะเบียนข้อจำกัดเช่นนี้ ท่านว่าจะถอนหรือแก้ให้หย่อนลงโดยนิติกรรมไม่ได้ นอกจากจะได้ทำนิติกรรมเป็นหนังสือและจดทะเบียนกับพนักงานเจ้าหน้าที่ข้อจำกัดซึ่งกำหนดไว้เพื่อสาธารณประโยชน์นั้น ท่านว่าจะถอนหรือแก้ให้หย่อนลงมิได้เลย
