บุคคลใดใช้สิทธิของตนเป็นเหตุให้เจ้าของอสังหาริมทรัพย์ได้รับความเสียหาย หรือเดือดร้อนเกินที่ควรคิดหรือคาดหมายได้ว่าจะเป็นไปตามปกติและเหตุอันควรในเมื่อเอาสภาพและตำแหน่งที่อยู่แห่งทรัพย์สินนั้นมาคำนึงประกอบไซร้ ท่านว่าเจ้าของอสังหาริมทรัพย์มีสิทธิจะปฏิบัติการเพื่อยังความเสียหายหรือเดือนร้อนนั้นให้สิ้นไป ทั้งนี้ ไม่ลบล้างสิทธิที่จะเรียกเอาค่าทดแทน
