บุคคลใดใช้สิทธิของตนเป็นเหตุให้เจ้าของอสังหาริมทรัพย์ได้รับความเสียหาย หรือเดือดร้อนเกินที่ควรคิดหรือคาดหมายได้ว่าจะเป็นไปตามปกติและเหตุอันควรในเมื่อเอาสภาพและตำแหน่งที่อยู่แห่งทรัพย์สินนั้นมาคำนึงประกอบไซร้ ท่านว่าเจ้าของอสังหาริมทรัพย์มีสิทธิจะปฏิบัติการเพื่อยังความเสียหายหรือเดือดร้อนนั้นให้สิ้นไป ทั้งนี้ ไม่ลบล้างสิทธิที่จะเรียกเอาค่าทดแทน

English translation
If a person in the exercise of his right causes to the owner of an immovable property greater injury or inconvenience than should naturally and reasonably be expected or anticipated, having regard to the nature and situation of such property, the owner is entitled, without prejudice to any claim for compensation, to have such injury or inconvenience abated.
