ถ้ามิได้กำหนดไว้เป็นอย่างอื่นในนิติกรรมอันก่อให้เกิดภาระจำยอมไซร้ ท่านว่าภาระจำยอมย่อมติดไปกับสามยทรัพย์ซึ่งได้จำหน่าย หรือตกไปในบังคับแห่งสิทธิอื่นท่านว่าจะจำหน่าย หรือทำให้ภาระจำยอมตกไปในบังคับแห่งสิทธิอื่นต่างหากจากสามยทรัพย์ไม่ได้

English translation
Unless otherwise provided in the act creating it, a servitude follows the dominant property when the latter is disposed of or made subject to other rights. A servitude cannot be disposed of or made subject to other rights apart from the dominant property.
