ถ้าผู้รับประโยชน์ละเลยไม่ปฏิบัติตามเงื่อนไขอันเป็นสาระสำคัญซึ่งระบุไว้ในนิติกรรมก่อตั้งภาระติดพันนั้นไซร้ ท่านว่าคู่กรณีอีกฝ่ายหนึ่งจะบอกเลิกสิทธิของผู้รับประโยชน์เสียก็ได้
