Section 1484 — Taking over or separating the marital property

ถ้าคู่สมรสฝ่ายซึ่งมีอำนาจจัดการสินสมรส
(๑) จัดการสินสมรสเป็นที่เสียหายถึงขนาด
(๒) ไม่อุปการะเลี้ยงดูอีกฝ่ายหนึ่ง
(๓) มีหนี้สินล้นพ้นตัว หรือทำหนี้เกินกึ่งหนึ่งของสินสมรส
(๔) ขัดขวางการจัดการสินสมรสของอีกฝ่ายหนึ่งโดยไม่มีเหตุผลอันสมควร
(๕) มีพฤติการณ์ปรากฏว่าจะทำความหายนะให้แก่สินสมรส
อีกฝ่ายหนึ่งอาจร้องขอให้ศาลสั่งอนุญาตให้ตนเป็นผู้จัดการสินสมรสแต่ผู้เดียวหรือสั่งให้แยกสินสมรสได้
ในกรณีตามวรรคหนึ่ง ถ้ามีคำขอ ศาลอาจกำหนดวิธีคุ้มครองชั่วคราวเพื่อจัดการสินสมรสได้ตามที่เห็นสมควร และหากเป็นกรณีฉุกเฉิน ให้นำบทบัญญัติเรื่องคำขอในเหตุฉุกเฉินตามประมวลกฎหมายวิธีพิจารณาความแพ่งมาใช้บังคับ

English translation
If the spouse who has the power to manage the marital property:
(1) manages it in a way that causes serious damage;
(2) fails to maintain the other spouse;
(3) is insolvent, or incurs debts exceeding one half of the marital property;
(4) obstructs the other spouse's management of the marital property without reasonable cause; or
(5) behaves in a way that appears likely to bring ruin upon the marital property;
the other spouse may apply to the court for an order permitting them to be the sole manager of the marital property, or for an order separating the marital property.
In a case under paragraph one, if application is made, the court may order such temporary protective measures for the management of the marital property as it thinks fit; and in a case of urgency, the provisions of the Civil Procedure Code on applications in cases of emergency apply.
