การสมรสที่เป็นโมฆะไม่ก่อให้เกิดความสัมพันธ์ทางทรัพย์สินระหว่างคู่สมรส

ในกรณีที่การสมรสเป็นโมฆะ ทรัพย์สินที่ฝ่ายใดมีหรือได้มาไม่ว่าก่อนหรือหลังการสมรส รวมทั้งดอกผลคงเป็นของฝ่ายนั้น ส่วนบรรดาทรัพย์สินที่ทำมาหาได้ร่วมกันให้แบ่งคนละครึ่ง เว้นแต่ศาลจะเห็นสมควรสั่งเป็นประการอื่น เมื่อได้พิเคราะห์ถึงภาระในครอบครัว ภาระในการหาเลี้ยงชีพ และฐานะของคู่กรณีทั้งสองฝ่าย ตลอดจนพฤติการณ์อื่นทั้งปวงแล้ว

English translation

A void marriage does not create any property relationship between the spouses.

Where a marriage is void, property which either party had or acquired, whether before or after the marriage, together with its fruits, remains the property of that party. Property jointly earned is divided equally between them, unless the court thinks fit to order otherwise, having regard to the responsibilities of the family, the responsibility of earning a living and the condition of both parties, and to all the other circumstances.
