ถ้าคู่สมรสได้ทำการสมรสโดยถูกกลฉ้อฉลอันถึงขนาดซึ่งถ้ามิได้มีกลฉ้อฉลนั้นจะไม่ทำการสมรส การสมรสนั้นเป็นโมฆียะความในวรรคหนึ่ง ไม่ใช้บังคับในกรณีที่กลฉ้อฉลนั้นเกิดขึ้นโดยบุคคลที่สามโดยคู่สมรสอีกฝ่ายหนึ่งมิได้รู้เห็นด้วยสิทธิขอเพิกถอนการสมรสเพราะถูกกลฉ้อฉลเป็นอันระงับเมื่อเวลาได้ผ่านพ้นไปแล้วเก้าสิบวันนับแต่วันที่รู้หรือควรได้รู้ถึงกลฉ้อฉล หรือเมื่อเวลาได้ผ่านพ้นไปแล้วหนึ่งปี นับแต่วันสมรส

English translation
A marriage is voidable if it is made by the spouoses on account of fraud to such an extent that without it the marriage would not have been made. The provisions of paragraph one shall not apply to the case not apply to the case where the other spouse has not known the fraud commited by a third person. The right to apply for cancellation of the marriage on account of fraud shall be terminated after the lapse of ninety days from the day on which the spouse has known or should have known of the fraud, or after the lapse of one year from the date marriage.
