ค่าอุปการะเลี้ยงดูระหว่างคู่สมรส หรือระหว่างบิดามารดากับบุตรนั้น ย่อมเรียกจากกันได้ในเมื่อฝ่ายที่ควรได้รับอุปการะเลี้ยงดูไม่ได้รับการอุปการะเลี้ยงดูหรือได้รับการอุปการะเลี้ยงดูไม่เพียงพอแก่อัตภาพ ค่าอุปการะเลี้ยงดูนี้ศาลอาจให้เพียงใดหรือไม่ให้ก็ได้ โดยคำนึงถึงความสามารถของผู้มีหน้าที่ต้องให้ ฐานะของผู้รับ และพฤติการณ์แห่งกรณี

English translation
Maintenance may be claimed between spouses, or between parents and children, where the party who ought to receive maintenance does not receive it, or receives maintenance insufficient to their condition in life. The court may grant such maintenance as it thinks fit, or refuse it, having regard to the ability of the person bound to provide it, the condition of the recipient, and the circumstances of the case.
