ในระหว่างเวลาที่ประเทศตกอยู่ในภาวะการรบหรือการสงคราม บุคคลที่รับราชการทหารหรือทำการเกี่ยวข้องอยู่กับราชการทหาร จะทำพินัยกรรมตามแบบที่บัญญัติไว้ในมาตรา ๑๖๕๘ มาตรา ๑๖๖๐ หรือมาตรา ๑๖๖๓ ก็ได้ ในกรณีเช่นว่านั้น ให้นายทหารหรือข้าราชการฝ่ายทหารชั้นสัญญาบัตรมีอำนาจและหน้าที่เช่นเดียวกับกรมการอำเภอ บทบัญญัติวรรคก่อนให้นำมาใช้บังคับแก่กรณีที่บุคคลที่รับราชการทหารหรือทำการเกี่ยวข้องอยู่กับราชการทหารทำพินัยกรรมในต่างประเทศในระหว่างที่ปฏิบัติการเพื่อประเทศในภาวะการรบหรือการสงครามในต่างประเทศโดยอนุโลม และในกรณีเช่นว่านี้ ให้นายทหารหรือข้าราชการฝ่ายทหารชั้นสัญญาบัตรมีอำนาจและหน้าที่เช่นเดียวกับพนักงานทูตหรือกงสุลฝ่ายไทย ถ้าผู้ทำพินัยกรรมตามความในสองวรรคก่อนนั้นป่วยเจ็บหรือต้องบาดเจ็บ และอยู่ในโรงพยาบาล ให้แพทย์แห่งโรงพยาบาลนั้นมีอำนาจและหน้าที่เช่นเดียวกับกรมการอำเภอหรือพนักงานทูต หรือกงสุลฝ่ายไทย แล้วแต่กรณีด้วย

English translation
During a time when the country is engaged in armed conflict or is at war, a person serving in, or employed in connection with, the armed forces may make a will in the form prescribed by Section 1658, Section 1660 or Section 1663. In such a case a commissioned military officer or commissioned military official has the same powers and duties as the district officer.
The preceding paragraph applies mutatis mutandis where such a person makes a will abroad while serving the country in armed conflict or war abroad; and in that case a commissioned military officer or commissioned military official has the same powers and duties as a Thai diplomatic or consular officer.
If a testator under either of the two preceding paragraphs is sick or wounded and is in hospital, a physician of that hospital also has the same powers and duties as the district officer, or as the Thai diplomatic or consular officer, as the case may be.
