ผู้มีส่วนได้เสียคนหนึ่งคนใดจะร้องขอให้ศาลสั่งถอนผู้จัดการมรดก เพราะเหตุผู้จัดการมรดกละเลยไม่ทำการตามหน้าที่ หรือเพราะเหตุอย่างอื่นที่สมควรก็ได้ แต่ต้องร้องขอเสียก่อนที่การปันมรดกเสร็จสิ้นลงแม้ถึงว่าจะได้เข้ารับตำแหน่งแล้วก็ดี ผู้จัดการมรดกจะลาออกจากตำแหน่งโดยมีเหตุอันสมควรก็ได้ แต่ต้องได้รับอนุญาตจากศาล

English translation

Any interested person may, prior to the completion of the distribution of the estate, apply to the Court for the discharge of an administrator for reason of neglect of his duties or any other reasonable cause. Even after having assumed his functions, the administrator may resign for any reasonable cause subject, however, to the permission of the Court.

Section 1727 is the safety valve when an administrator self-deals, hides assets, or simply stops doing the job. Grounds the court accepts: (1) misappropriation of estate property; (2) failure to file inventory or account within reasonable time; (3) conflicts of interest (e.g., administrator is also a major creditor); (4) becoming incapacitated. The petitioner must show specific facts, not general dissatisfaction. Successful removal also typically requires the petitioner to nominate a replacement.
