เจ้าหนี้จะใช้สิทธิเรียกร้องของลูกหนี้เรียกเงินเต็มจำนวนที่ยังค้างชำระแก่ลูกหนี้ โดยไม่ต้องคำนึงถึงจำนวนที่ค้างชำระแก่ตนก็ได้ ถ้าจำเลยยอมใช้เงินเพียงเท่าจำนวนที่ลูกหนี้เดิมค้างชำระแก่เจ้าหนี้นั้น คดีก็เป็นเสร็จกันไป แต่ถ้าลูกหนี้เดิมได้เข้าชื่อเป็นโจทก์ด้วย ลูกหนี้เดิมจะขอให้ศาลพิจารณาพิพากษาต่อไปในส่วนจำนวนเงินที่ยังเหลือติดค้างอยู่ก็ได้แต่อย่างไรก็ดี ท่านมิให้เจ้าหนี้ได้รับมากไปกว่าจำนวนที่ค้างชำระแก่ตนนั้นเลย

English translation

A creditor may exercise a claim belonging to the debtor for the whole amount due to the debtor, without regard to the amount due to him. But the defendant may satisfy the creditor by paying the amount due to him alone, provided that if the original debtor has joined as a plaintiff he may proceed to judgment for the balance. In any case the creditor cannot obtain more than what is due to him.
