(๒) แห่งประมวลกฎหมายนี้ถ้าการจัดการทำศพ ต้องชักช้าไปด้วยประการใด ๆ ให้บุคคลผู้มีอำนาจตามความในมาตราก่อนกันเงินเป็นจำนวนอันสมควรจากสินทรัพย์แห่งกองมรดกเพื่อใช้ในการนี้ โดยให้บุคคลผู้มีส่วนได้เสียคนใดคนหนึ่งร้องต่อศาลได้ในกรณีที่ไม่ตกลงหรือคัดค้านการกันเงินจำนวนนั้นกรณีจะเป็นอย่างไรก็ตาม เงินค่าใช้จ่าย หรือเงินที่กันไว้อันเกี่ยวกับการจัดการทำศพนั้น ให้กันไว้ได้แต่เพียงจำนวนตามสมควรแก่ฐานะในสมาคมของผู้ตาย แต่จะต้องไม่เป็นการเสื่อมเสียต่อสิทธิของเจ้าหนี้ของผู้ตาย

English translation
When a preferential right conflicts with a special preferential right, the latter takes precedence, but the preferential rights on account of expenses for the common benefit takes precedence as against all creditors who are benefited thereby.
