ถ้าหนี้มีอยู่เป็นคุณแก่บุคคลผู้ใดในมูลอย่างหนึ่งอย่างใดดังจะกล่าวต่อไปนี้ บุคคลผู้นั้นย่อมมีบุริมสิทธิเหนือทรัพย์สินทั้งหมดของลูกหนี้ คือ (๑) ค่าใช้จ่ายเพื่อประโยชน์อันร่วมกัน (๒) ค่าปลงศพ (๓) ค่าภาษีอากร และเงินที่ลูกจ้างมีสิทธิได้รับเพื่อการงานที่ได้ทำให้แก่ลูกหนี้ซึ่งเป็นนายจ้าง (๔) ค่าเครื่องอุปโภคบริโภคอันจำเป็นประจำวัน

If a debt is owed to any person on any of the following grounds, that person has a preferential right over the whole of the debtor's property:
(1) expenses incurred for the common benefit;
(2) funeral expenses;
(3) taxes and duties, and money to which an employee is entitled for work done for the debtor as employer;
(4) the cost of daily necessaries.
