การที่เจ้าหนี้ร่วมกันคนหนึ่งผิดนัดนั้น ย่อมเป็นโทษแก่เจ้าหนี้คนอื่น ๆ ด้วย ถ้าสิทธิเรียกร้องและหนี้สินนั้นเป็นอันเกลื่อนกลืนกันไปในเจ้าหนี้ร่วมกันคนหนึ่ง สิทธิของเจ้าหนี้คนอื่น ๆ อันมีต่อลูกหนี้ก็ย่อมเป็นอันระงับสิ้นไป นอกจากนี้ ท่านให้นำบทบัญญัติแห่งมาตรา ๒๙๒ ๒๙๓ และ ๒๙๕ มาใช้บังคับด้วยโดยอนุโลม กล่าวโดยเฉพาะก็คือ แม้เจ้าหนี้ร่วมกันคนหนึ่งจะโอนสิทธิเรียกร้องให้แก่บุคคลอื่นไปก็หากระทบกระทั่งถึงสิทธิของเจ้าหนี้คนอื่น ๆ ด้วยไม่

English translation

Default on the part of one joint creditor avails also against the other creditors. If a claim and a debt become merged in one joint creditor, the rights of the other creditors against the debtor are extinguished. For the rest the provisions of Sections 292, 293 and 295 apply mutatis mutandis. In particular, if one joint creditor transfers his claim to another person, the rights of the other creditors remain unaffected.
