การที่เจ้าหนี้ร่วมกันคนหนึ่งผิดนัดนั้น ย่อมเป็นโทษแก่เจ้าหนี้คนอื่น ๆ ด้วย ถ้าสิทธิเรียกร้องและหนี้สินนั้นเป็นอันเกลื่อนกลืนกันไปในเจ้าหนี้ร่วมกันคนหนึ่ง สิทธิของเจ้าหนี้คนอื่น ๆ อันมีต่อลูกหนี้ก็ย่อมเป็นอันระงับสิ้นไป นอกจากนี้ ท่านให้นำบทบัญญัติแห่งมาตรา ๒๙๒ ๒๙๓ และ ๒๙๕ มาใช้บังคับด้วยโดยอนุโลม กล่าวโดยเฉพาะก็คือ แม้เจ้าหนี้ร่วมกันคนหนึ่งจะโอนสิทธิเรียกร้องให้แก่บุคคลอื่นไปก็หากระทบกระทั่งถึงสิทธิของเจ้าหนี้คนอื่น ๆ ด้วยไม่

Le défaut de paiement d'un créancier solidaire est opposable aux autres créanciers. Si une créance et une dette sont fusionnées au sein d'un même créancier solidaire, les droits des autres créanciers à l'encontre du débiteur s'éteignent. Pour le reste, les dispositions des articles 292, 293 et 295 s'appliquent mutatis mutandis. En particulier, si un créancier solidaire cède sa créance à un tiers, les droits des autres créanciers demeurent intacts.
