ผู้ขายย่อมไม่ต้องรับผิดในกรณีดังจะกล่าวต่อไปนี้ คือ(๑) ถ้าผู้ซื้อได้รู้อยู่แล้วแต่ในเวลาซื้อขายว่ามีความชำรุดบกพร่อง หรือควรจะได้รู้เช่นนั้นหากได้ใช้ความระมัดระวังอันจะพึงคาดหมายได้แต่วิญญูชน(๒) ถ้าความชำรุดบกพร่องนั้นเป็นอันเห็นประจักษ์แล้วในเวลาส่งมอบ และผู้ซื้อรับเอาทรัพย์สินนั้นไว้โดยมิได้อิดเอื้อน(๓) ถ้าทรัพย์สินนั้นได้ขายทอดตลาด

English translation

The seller is not liable in the following cases: (1) If the buyer knew of the defect at the time of sale, or would have known of it if he had exercised such care as might be expected from a person of ordinary prudence. (2) If the defect was apparent at the time of the delivery, and the buyer accepts the property without reservation. (3) If the property was ;old by public auction.
