ในกรณีที่ทรัพย์สินซึ่งขายนั้นชำรุดบกพร่องอย่างหนึ่งอย่างใด อันเป็นเหตุให้เสื่อมราคาหรือเสื่อมความเหมาะสมแก่ประโยชน์อันมุ่งจะใช้เป็นปกติก็ดี ประโยชน์ที่มุ่งหมายโดยสัญญาก็ดี ท่านว่าผู้ขายต้องรับผิดความที่กล่าวมาในมาตรานี้ย่อมใช้ได้ ทั้งที่ผู้ขายรู้อยู่แล้วหรือไม่รู้ว่าความชำรุดบกพร่องมีอยู่

English translation
In case of any defect in the property sold which impairs either its value or its fitness for ordinary purposes, or for the purposes of the contract, the seller is liable. The foregoing provision applies whether the seller knew or did not know of the existence of the defect.
