ถ้าอสังหาริมทรัพย์ต้องศาลแสดงว่าตกอยู่ในบังคับแห่งภาระจำยอมโดยกฎหมายไซร้ ท่านว่าผู้ขายไม่ต้องรับผิด เว้นไว้แต่ผู้ขายจะได้รับรองไว้ในสัญญาว่าทรัพย์สินนั้นปลอดจากภาระจำยอมอย่างใด ๆ ทั้งสิ้น หรือปลอดจากภาระจำยอมอันนั้น

English translation
If an immovable property is declared to be subject to a servitude established by law, the seller is not liable unless he has expressly guaranteed that the property was free from servitudes, or from that particular servitude.
