ถ้าผู้รับจ้างเป็นผู้จัดหาสัมภาระ และการที่จ้างทำนั้นพังทลายหรือบุบสลายลงก่อนได้ส่งมอบกันถูกต้องไซร้ ท่านว่าความวินาศอันนั้นตกเป็นพับแก่ผู้รับจ้าง หากความวินาศนั้นมิได้เป็นเพราะการกระทำของผู้ว่าจ้างในกรณีเช่นว่านี้ สินจ้างก็เป็นอันไม่ต้องใช้

English translation
If the materials have been supplied by the contractor, and the work is destroyed or damaged before due delivery, the contractor bears the loss provided that such loss is not caused by any act of the employer. In such case no remuneration is payable.
