ผู้ค้ำประกันซึ่งได้ชำระหนี้แล้ว ย่อมมีสิทธิที่จะไล่เบี้ยเอาจากลูกหนี้ เพื่อต้นเงินกับดอกเบี้ยและเพื่อการที่ต้องสูญหายหรือเสียหายไปอย่างใด ๆ เพราะการค้ำประกันนั้นอนึ่ง ผู้ค้ำประกันย่อมเข้ารับช่วงสิทธิของเจ้าหนี้บรรดามีเหนือลูกหนี้ด้วย

English translation
A surety who has performed the obligation has a right of recourse against the debtor for the principal and interest, and for any loss or damage suffered by reason of the suretyship.
The surety is also subrogated to the rights of the creditor against the debtor.
