Book 3: Specific Contracts

Section 717: Mortgage over property divided into parts

Verbatim from the Royal Gazette / Office of the Council of State

English translation

Even though the mortgaged property is divided into several parts, the mortgage still extends to all of those parts together.
Nevertheless, if the mortgagee consents, any part of the property may be transferred free of the mortgage; but such consent, if it has not been registered, may not be set up against third persons.
