ถ้าสิทธิซึ่งจำนำนั้นถึงกำหนดชำระก่อนหนี้ซึ่งประกันไว้นั้นไซร้ ท่านว่าลูกหนี้แห่งสิทธิต้องส่งมอบทรัพย์สินอันเป็นวัตถุแห่งสิทธิให้แก่ผู้รับจำนำ และทรัพย์สินนั้นก็กลายเป็นของจำนำแทนสิทธิซึ่งจำนำถ้าสิทธิซึ่งจำนำนั้นเป็นมูลหนี้ซึ่งต้องชำระเป็นเงิน และถึงกำหนดชำระก่อนหนี้ซึ่งประกันไว้นั้นไซร้ ท่านว่าต้องใช้เงินให้แก่ผู้รับจำนำและผู้จำนำร่วมกัน ถ้าและเขาทั้งสองนั้นไม่ปรองดองตกลงกันได้ ท่านว่าแต่ละคนชอบที่จะเรียกให้วางเงินจำนวนนั้นไว้ ณ สำนักงานฝากทรัพย์ได้เพื่อประโยชน์อันร่วมกัน

English translation
If the pledged right becomes due before the obligation for which it is security is due, the debtor of such right must deliver to the pledge the property which is the subject of the right and it becomes pledged in lieu of the pledged right. If the pledged right is an obligation to pay a sum of money and becomes due before the obligation secured, the payment must be made jointly to the pledge and pledgor; if they cannot come to an agreement, each of them is entitled to demand that such sum be deposited in Deposited Office for their common benefit.
