Si le droit nanti devient exigible avant l'obligation garantie, le débiteur de ce droit doit remettre au créancier gagiste le bien qui en constitue l'objet, lequel est alors nanti en lieu et place du droit nanti. Si le droit nanti porte sur une obligation de payer une somme d'argent et devient exigible avant l'obligation garantie, le paiement est effectué conjointement au créancier gagiste et au débiteur gagiste ; à défaut d'accord, chacun d'eux peut exiger que cette somme soit déposée auprès d'un organisme de dépôt pour leur bénéfice commun.
