ถ้าไม่สามารถจะบอกกล่าวก่อนได้ ผู้รับจำนำจะเอาทรัพย์สินจำนำออกขายทอดตลาดเสียในเมื่อหนี้ค้างชำระมาล่วงเวลาเดือนหนึ่งแล้วก็ให้ทำได้
