เมื่อจะบังคับจำนำ ผู้รับจำนำต้องบอกกล่าวเป็นหนังสือไปยังลูกหนี้ก่อนว่า ให้ชำระหนี้และอุปกรณ์ภายในเวลาอันควรซึ่งกำหนดให้ในคำบอกกล่าวนั้นถ้าลูกหนี้ละเลยไม่ปฏิบัติตามคำบอกกล่าว ผู้รับจำนำชอบที่จะเอาทรัพย์สินซึ่งจำนำออกขายได้ แต่ต้องขายทอดตลาดอนึ่ง ผู้รับจำนำต้องมีจดหมายบอกกล่าวไปยังผู้จำนำบอกเวลาและสถานที่ซึ่งจะขายทอดตลาดด้วย

English translation

On enforcement of the pledge, the pledgee must first give written notice to the debtor to perform the obligation and its accessories within a reasonable time to be fixed in the notice. If the debtor neglects to comply with the notice, the pledgee is entitled to sell the pledged property, but the sale must be by public auction. The pledgee must also give written notice to the pledgor of the time and place of the auction.
