ถ้าหนี้ซึ่งสินค้าจำนำเป็นประกันมิได้ชำระเมื่อวันถึงกำหนดไซร้ ผู้ทรงประทวนสินค้าเมื่อได้ยื่นคำคัดค้านตามระเบียบแล้ว ชอบที่จะให้นายคลังสินค้าขายทอดตลาดสินค้านั้นได้ แต่ท่านห้ามมิให้ขายทอดตลาดก่อนแปดวันนับแต่วันคัดค้าน
