บุคคลผู้ใดตกลงจะให้ค่าบำเหน็จแก่นายหน้าเพื่อที่ชี้ช่องให้ได้เข้าทำสัญญาก็ดี จัดการให้ได้ทำสัญญากันก็ดี ท่านว่าบุคคลผู้นั้นจะต้องรับผิดใช้ค่าบำเหน็จก็ต่อเมื่อสัญญานั้นได้ทำกันสำเร็จเนื่องแต่ผลแห่งการที่นายหน้าได้ชี้ช่องหรือจัดการนั้น ถ้าสัญญาที่ได้ทำกันไว้นั้นมีเงื่อนไขเป็นเงื่อนบังคับก่อนไซร้ ท่านว่าจะเรียกร้องบำเหน็จค่านายหน้ายังหาได้ไม่ จนกว่าเงื่อนไขนั้นสำเร็จแล้วนายหน้ามีสิทธิจะได้รับชดใช้ค่าใช้จ่ายที่ได้เสียไปก็ต่อเมื่อได้ตกลงกันไว้เช่นนั้น ความข้อนี้ท่านให้ใช้บังคับแม้ถึงว่าสัญญาจะมิได้ทำกันสำเร็จ

English translation
A person who agrees to pay remuneration to a broker for indicating the opportunity for the conclusion of a contract, or for procuring a contract, is liable to pay the remuneration only if the contract is concluded in consequence of the indication or of the procurement by the broker. If the contract is concluded subject to a condition precedent, the broker's remuneration may not be claimed until the condition is fulfilled. feedback (/form/1-samuiforsale-contact-form.html?tmpl=component) / The broker is entitled to be reimbursed for expenses incurred only if it has been agreed upon. This applies even if a contract is not concluded.
